These Rules set out the principles for sales and use of Gift Cards sold by Artists Society LTD, as well as the rules and duties of the Buyer and the User.
Terms used in these Rules shall have the following meaning:
Publisher – Artists Society LTD, Suite 305, Griffith Corporate Centre, P.O. Box 1510, Beachmont Kingstown St. Vincent and the Grenadines.
Gift Card also referred to as the Voucher – bearer e-voucher for goods that can be used by the User in the pixers.uk transaction service, with a value equal the nominal value shown on the Voucher, with a unique code, allowing purchasing a Graphic Service offered in the pixers.uk transaction service.
Buyer – a natural person (over 18 years old), including a consumer, a legal person or an organisational unit having legal capacity, who in exchange for transferring cash in the amount equivalent to the nominal value of the Voucher to the Publisher’s account receives the Gift Card from the Publisher.
User – a holder of the Gift Card.
Graphic Service – graphic designing service provided within the framework of the pixers.uk transaction service, on terms set out in the Rules for Sales of Graphic Service.
Rules for Sales of Graphic Service – Rules including terms of sales of the Graphic Service by the Publisher, available in the pixers.uk transaction service as Terms of Services provided by Artists Society LTD.
pixers.uk Transaction Service – internet service functioning in the www.pixers.uk domain, allowing purchasing the Graphic Service or the Gift Card.
Consumer – a natural person concluding with an entrepreneur a legal transaction that is not directly related to this person’s business or professional activities.
Matters not covered by these Rules shall be governed by provisions of the Rules for Sales of Graphic Service.
The Voucher can be purchased through the pixers.uk transaction service on terms set out in these Rules.
The Publisher undertakes to send the Voucher to the e-mail address identified by the Buyer, against the agreed fee.
The Buyer undertakes to transfer cash in the amount equal the nominal value of the voucher to the Publisher and to use the Voucher within its validity period.
Subject to § 4 section 1 of these Rules, the Gift Card cannot be converted to cash in whole or in part, or to any other items.
The Buyer and the User shall not have any claims against the Publisher in the case of loss/theft of the Gift Card that was sent by the Publisher to the e-mail address identified by the Buyer.
The validity period of the Gift Card shall be 1 year. This period shall start running since the day of sending the Voucher to the e-mail address identified by the Buyer. If any funds remain unused on the Voucher despite the expiry of the validity period of the voucher, these funds cannot be withdrawn in form of cash.
The Gift Card may have various nominal values that are in detail identified in the pixers.uk transaction service, whereas the Buyer may select an individual amount from £5 to £99999 in the service.
After clicking the “Go to checkout” button, the Voucher order card with the personal data form, selection of the payment method and Voucher delivery options are displayed.
The payment for the Gift Card can be made by standard transfer, e-transfer or payment card.
Clicking the “Pay securely” button shall mean placing the order with the duty to pay, and the contract for the Gift Card shall be concluded at the same time.
The Publisher shall endeavour to send the Gift Card to the e-mail address identified by the Buyer immediately (but within no more than 24 hours) after the full amount is paid to the Publisher's bank account or after the Internet payment intermediary notifies of crediting the Publisher’s account.
The Voucher can be used only in the pixers.uk transaction service and only for the purposes of paying for the Graphic Service bought via this service.
The Voucher can be used only in one Graphic Service purchase process (or in the process involving purchasing a few Graphic Services based on one order), i.e. the code from the Voucher should be entered into the relevant field, as a result of which the price for the Graphic Service will be reduced by the relevant nominal value of the Voucher.
The User can use the Gift Card only once, i.e. for the purposes of one order, within its validity period. If the price of the Graphic Service purchased using the Gift Card is lower than the nominal value of the Voucher, the remaining part of the nominal value of the Voucher shall be lost and cannot be used in the next purchase transaction.
If the value of the order paid for with the Voucher is higher than the nominal value of the Voucher, the User shall be obliged to pay the price difference. The balancing payment shall be made using the payment methods available in the pixers.uk transaction service.
Vouchers subject to these Rules cannot be combined, which means that only one Voucher can be used when placing the particular order.
In the case of withdrawing from the contract for the purchase of the Graphic Service and acquiring the right to return of the price of the Graphic Service, the part of the price of the Graphic Service settled using the Voucher shall be re-assigned to the Voucher (supplement the amount limit of the Voucher), provided however that it take place within the validity period of the particular Voucher, as referred to in § 2 section 6 of these Rules.
In no case, the Voucher value will be paid out in cash.
The Voucher sale transaction shall not be the sale transaction subject to tax on goods and services (VAT) within the meaning of applicable legal regulations.
Within the meaning of applicable legal regulations, the Voucher shall be not an electronic payment instrument or an electronic payment card. The Voucher is a gift voucher in electronic form.
The Voucher shall not be considered purchase of a service, but only a document entitling to obtain a certain service for the amount shown on the Voucher. Taking into account the above, there are no basis for issuing the invoice upon purchase of the Voucher.
The Publisher reserves the right to amend these Rules for important reasons, however the rights already acquired will be respected. Any amendments shall come into force on the date of making them by the Publisher, after the amended Rules are made available and the amendments are announced.
The Rules shall come into force as of 17.05.2019.
