REGULATIONS OF THE AFFILIATION PROGRAM

§ 1
[definitions]

  1. These Regulations set out the rules for participation in the Affiliate Program run by Pixers Rnd Ltd with its registered seat in the UK, 590 Kingston Road, London, SW20 8DN, registered in the commercial register at Companies House under number 131732737.
  2. The terms indicated below used in the Regulations have the following meaning:
AccountWebsite functionality, enabling the Partner, after logging in to the Website using an individual login and password, to access resources in the IT system, including generating an Affiliate Link to Products
Account Serviceservice that enables the Partner to register an Account and access to this Account

§ 2
[general provisions]

  1. Regulations define the rules of cooperation under the Affiliate Program as well as define the scope of rights and obligations of the Administrator and Partner.
  2. The condition of concluding cooperation under the Affiliate Program is the Partner\'s acceptance of the Regulations and successful Account creation.
  3. Administrator provides the Partner with an electronic service enabling the Partner to set up an Account and access to this Account ("Account Service").
  4. The Partner is obliged to use the Affiliate Program in a manner consistent with the Regulations and legal provisions.
  5. In order to properly use the Affiliate Program and all its functionalities, it is necessary to meet the technical requirements in the form of: having a device with Internet access, having an e-mail account, as well as installing the newest versions of Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, or Safari web browser. The web browser should be enabled for cookies.

§ 3
[[Affiliate Program]

  1. Participation in the Affiliate Program is completely free of charge and requires the registration of an Account.
  2. Participation in the Affiliate Program is only allowed for Partners over 18 years of age.
  3. To participate in the Affiliate Program, the Partner must also, after creating the Account:
    1. provide e-mail address assigned to the PayPal account to which the Commission will be paid;
    2. choose the currency in which the Commission will be paid (selected from the group of currencies accepted by the Administrator, including, among others, GBP, EUR, PLN, and USD).
  4. The choice of the currency in which the Commission will be paid is final and cannot be changed.
  5. After successfully joining the Affiliate Program after creating and activating the Account as well as fulfilling the conditions referred to in section 3, the Partner shall be given the opportunity to generate Affiliate Links to Products.
  6. After using the Affiliate Link, a 30-day cookie file will be saved on the potential Customer\'s device. If the Product is purchased by the Customer after using the Affiliate Link during the cookie\'s validity period, the Partner is entitled to a Purchase Commission on the terms described in §5.
  7. Under the Affiliate Program, the Partner may voluntarily advertise Administrator\'s brand by posting Affiliate Links on the Internet in accordance with the rules of netiquette.
  8. It is forbidden to distribute Affiliate Links in the form of spam, malware and on sites that provide pornographic, racist, violent, or seditious content.
  9. It is also forbidden to distribute Affiliate Links through iframe tags or any other similar method that would result in adding cookies from Website to the Customer’s browser (with exception regarding iframe tags generated through Pixers scripts).
  10. Advertisement of Affiliate Links may not occur as part of activities that may constitute an act of unfair competition.
  11. Partner obliges that he will not publish unjustified negative opinions about the Administrator and products.
  12. Partner obliges that he will not use any phrases connected to the Pixers brand for the purpose of online marketing.
  13. The agreement regarding the Affiliate Program is concluded upon the creation of the Account as well as well after meeting the conditions indicated in section 3 and is provided for an indefinite period. Termination of the agreement regarding the Affiliate Program may occur on the principles set out in §4 section 2.
  14. Administrator reserves the right to exclude a Partner from the Affiliate Program, delete the Account, cancel the ordered payments of Commission as well as withdraw from the agreement with immediate effect if the Partner violates the provisions of the Regulations.

§ 4
[Account]

  1. The Account service is provided free of charge.
  2. The agreement regarding the Account Service is concluded upon registration on the Website and is provided for an indefinite period. However, Partner has the option to withdraw at any time, without giving a reason. The resignation from this service may take place by sending relevant information to the Administrator, in particular via e-mail or traditional mail. After submitting the statement, the Administrator will immediately delete the Partner Account. Withdrawing from the Account Service means the termination of the agreement regarding the Affiliate Program, however, it does not affect the already commissioned transfer orders of the Commission.
  3. Partner is required to provide correct and factual data in the Registration Form.
  4. Registration of an Account requires:
    1. completing the Registration Form available on the Website by providing the data required in it, including the e-mail address and password that the Partner will use to log into the Account;
    2. accepting the provisions of these Regulations; the statement of acceptance of the Regulations is submitted electronically by selecting the appropriate option under the Registration Form;
    3. clicking the button confirming the creation of an Account;
    4. clicking the Account activation button, which will be sent by the Administrator by e-mail.
  5. After registration and activation of the Account, the Partner gains access to it. Access to the Account is possible after logging in to the Website.
  6. Logging in to the Account is done by filling out the appropriate form available on the Website and providing the data required in it, i.e. the Partner\'s e-mail address and password, and clicking the login button.
  7. Administrator protects the privacy of Partners and processes personal data only in accordance with the law. The password used by the Partner is secured and encrypted, and the Administrator cannot access it.
  8. The Partner is obliged to use only his own Account. The Partner is obliged to keep secret and not to disclose to third parties data enabling access to his Account.
  9. Administrator will make every effort to ensure that data transmission as part of using the Service is secure, i.e. that the information sent via the Internet is transmitted in a confidential and complete manner.
  10. Administrator reserves the right to block the Partner from using the functionality of the Account in the event of his violation of the provisions of the Regulations.

§ 5
[Commission]

  1. In the case of purchase of Products by the Customer on the terms set out in §3 section 6, the Partner will be credited the Commission of 5% of the value of the Products and shipping costs. The Administrator reserves the right to lower the percentage of Commission entitled to the Partner for future purchases.
  2. Commission will be credited to the Partner only if, after 30 days from the date of purchasing the Products through the Affiliate Link, the purchase has been completed and the Customer did not withdraw from the Products’ purchase.
  3. The Partner may check the Commission currently credited to him by using the appropriate panel on the Website after logging into the Account.
  4. In the event of return of the part of the Products purchased through the Affiliate Link under the given order within the 30 days from the date of purchase, the Partner will be entitled to a Commission only for the purchase of non-returned Products.
  5. Payments of the Commission are made at the Partner\'s request to the PayPal account indicated by him at the time of registration of the Account. The Administrator reserves the right to confirm, within 7 business days, whether the Commission has been calculated properly.
  6. Payments of Commission will be made on the basis of payment requests indicated in section 5, within 30 days of the Administrator’s confirmation of the proper calculation of the Commission.
  7. Commission subject to payment is gross sum and it will not be reduced by any amounts. Partner shall be obliged to deduct from the entitled Commission and pay to authorized entities any taxes and dues in accordance with generally applicable law applicable in a given case.
  8. The minimum amount of Commission that the Partner is allowed to withdrawal depends on the currency chosen by the Partner and is respectively 100 GBP/100 EUR/100 USD/200 PLN.
  9. Administrator reserves the right to suspend the payment of the Commission, in case of doubts as to compliance by the Partner with the Regulations until the final clarification with the Partner, which will not give the Partner the right to charge any additional fees, including statutory interest for late payment.
  10. Administrator agrees to delivery of the bills and invoices in electronic form to the following e-mail address: affiliation@pixers.uk.

§ 6
[complaints]

  1. The Partner may submit a complaint regarding the Affiliate Program and service in the form of:
    1. in writing to the address given in § 1 section 1 of the Regulations;
    2. e-mail to address affiliation@pixers.uk.
  2. The complaint should contain a brief description of the case and the actions requested by the Partner.
  3. Administrator shall consider the complaint and respond to it no later than within 30 days of its receipt.
  4. Administrator reserves the right to extend the deadline for responding to a complaint by a further 14 days if the analysis of a complaint encounters obstacles for reasons beyond the control of the Administrator.
  5. Analysis of complaints may result in the need to obtain additional information or explanations from the Partner, which will be associated with each appropriate extension of the deadline for consideration of the complaint for the time of providing information or explanations by the Partner.

§ 7
[personal data]

  1. Controller of the Partners\' personal data is Pixers Rnd Ltd with its registered seat in the UK, 590 Kingston Road, London, SW20 8DN, registered in the commercial register at Companies House under number 131732737.
  2. The processing of Partners\' personal data takes place in accordance with the provisions of generally applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("GDPR"), as well as in accordance with these Regulations.
  3. As a part of the activities of the Affiliate Program, personal data provided by the Partners are processed, such as name and surname, company name, TAX id., registered office address, correspondence address, if different from the registered office address, e-mail address provided during Account registration and address email associated with the PayPal account.
  4. Providing personal data is voluntary, but necessary to conclude and implement the Affiliate Program.
  5. The processing of Partners\' personal data also takes place in order to conclude and implement agreement for the provision of electronic services and cooperation under the Affiliate Program set out in the Regulations (Article 6 section 1 let. b of the GDPR. Administrator stores the data for a maximum of 10 years from the date the Partner ceased participation in the Affiliate Program.
  6. The data subject has the following rights:
    1. the right to access the personal data provided and the law
    2. to receive their copy;
    3. the right to rectify personal data;
    4. the right to delete personal data;
    5. the right to request restriction of the processing of personal data;
    6. the right to transfer personal data;
    7. the right to object to the processing of personal data provided;
    8. the right to lodge a complaint with a supervisory authority.
  7. Administrator provides protection for personal data it processes. In particular, Administrator applies appropriate technical and organizational measures to ensure the protection of personal data being processed, appropriate to the threats and categories of data being protected. In particular, it protects data against unauthorized access, removal by an unauthorized person, processing in violation of the law and change, loss, damage, or destruction.
  8. In order to exercise any of the rights referred to above, the data subject may submit a request to the Administration via e-mail or post.

§ 8
[liability]

  1. Administrator\'s liability for damage caused to the Partner in connection with non-performance or improper performance of services is limited to damage actually incurred and the total compensation for damage suffered by the Partner may not exceed the amount of the Commission paid to the Partner so far.
  2. Parties mutually exclude the Administrator\'s liability for lost profits.
  3. Administrator is not responsible for non-performance or improper performance of services in cases where the non-performance or improper performance of services were the result of circumstances involving third parties.
  4. The Partner is solely responsible for the content of the data provided by him.

§ 9
[amendment of the Regulations]

  1. Administrator is entitled to amend these Regulations for reasons such as changing of the law, changing the data provided in the forms or amendment of the way the Affiliate Program operates.
  2. The amendment to the Regulations shall enter into force on the date indicated by the Administrator - which shall not be less than 7 days from the date of the new Regulations being made available on the Website.
  3. Each Partner having an Account will be notified of amendments of the Regulations. Amendments to the Regulations bind the Partner if he has not terminated the agreement for the provision of electronic services and the Affiliate Program agreement within 7 days of being notified of the changes. Notice of termination may be sent by e-mail or post. In the event of termination of the agreement for the provision of electronic services and the Affiliate Program agreement, the Administrator shall immediately delete the Partner\'s Account.

§ 10
[final provisions]

  1. Regulations are available on the Website and at the headquarters of the Administrator.
  2. The law applicable to the obligations arising from the Regulations is English law.
  3. In matters not covered by these Regulations, the provisions of English law shall apply.
  4. The Regulations enter in force since 1st July 2020.
